Florida is one of only two U.S. states that does NOT require Bodily Injury Liability for most drivers. That single fact makes Florida's minimum requirements among the weakest in the nation. Here's what the law actually says in 2026 — and why you should carry far more.

Florida's 2026 minimum requirements

Every registered vehicle in Florida must carry: $10,000 Personal Injury Protection (PIP) and $10,000 Property Damage Liability (PDL). That's it. No Bodily Injury Liability is required for most drivers (exceptions for DUI convictions and certain commercial vehicles, which require FR-44 limits of $100k/$300k/$50k).

Why this 'minimum' is dangerous

$10,000 in PDL won't even total a modern pickup truck. $10,000 in PIP only covers 80% of your own medical bills up to that cap — one ER visit can blow through it. And with no required Bodily Injury Liability, if you cause a serious accident, the injured driver can sue you personally — putting your home, savings, and wages at risk.

What happens if you drive uninsured

Florida penalties: license and registration suspension for up to 3 years, $150 reinstatement fee for the first offense ($250 second, $500 third), and you'll be required to file an SR-22 for 3 years afterward. You also lose all legal immunity under Florida's no-fault system — meaning you can be sued for the full damages.
